1) Acceptance of Terms

By downloading, accessing, or using the Amsler App (the “App”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the App.

2) Intended Use; Not Medical Advice

The App provides visual screening tools (e.g., an Amsler grid) designed solely for informational and educational purposes to help users self-monitor perceived visual distortion or changes over time. The App is not a medical device, has not been cleared or approved by the U.S. Food and Drug Administration, and does not provide medical advice, diagnosis, or treatment.

Do not rely on the App for medical decision-making. Results may vary based on lighting, screen size, device calibration, viewing distance, and user technique. The App cannot detect all vision problems and does not continuously monitor for abnormalities. If you notice new or worsening visual symptoms, contact a qualified eye-care professional promptly.

No emergency use: Do not use the App to diagnose or treat emergencies. If you experience sudden vision changes or think you may have a medical emergency, call your local emergency number or contact an eye-care professional immediately.

3) Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the App. If you are under the age of majority, you must have parental/guardian permission.

4) Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms. The App does not transmit Amsler test results to us and is designed to avoid collecting personal data directly. The App displays third-party advertisements (e.g., Google AdMob) that may collect device and usage data for ad delivery and measurement; such providers may act as independent controllers under their own policies. If future versions introduce optional system integrations (e.g., Apple Health/HealthKit), access will require your explicit permission via OS settings.

5) License and Restrictions

We grant you a limited, revocable, non-exclusive, non-transferable license to install and use the App on a device you own or control for personal, non-commercial use, in accordance with these Terms and the applicable app-store rules.

You agree not to: (a) reverse engineer, decompile, or attempt to derive the App’s source code except where permitted by law; (b) circumvent any security or technical measures; (c) use the App to develop competing products, or for any unlawful, harmful, fraudulent, infringing, or abusive purpose; or (d) interfere with or disrupt the App or related services.

6) Third-Party Services & Links

The App may display ads and link to third-party websites, content, or services (e.g., eye-care provider sites). We do not control and are not responsible for third-party content, policies, or practices. Your interactions with third parties are solely between you and the third party.

7) Intellectual Property

The App and all related content (excluding third-party content) are owned by or licensed to First Eye Applications and are protected by intellectual property laws. We reserve all rights not expressly granted.

8) Feedback

If you provide feedback, ideas, or suggestions, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use and incorporate that feedback without restriction or compensation.

9) Updates & Availability

We may update, modify, or discontinue the App (in whole or part) at any time. We have no obligation to maintain or support any particular version or feature.

10) Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.

Medical limitation: The App is not intended for use in the diagnosis, cure, mitigation, treatment, or prevention of any disease, and no guarantee of accuracy or completeness is made regarding visual test results.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FIRST EYE APPLICATIONS OR ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT ANY LIABILITY IS FOUND, OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID (IF ANY) FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM—WHICHEVER IS GREATER.

Clinical reliance exclusion: We are not responsible for any medical decisions, missed diagnoses, or outcomes arising from reliance on the App’s visual information.

Some jurisdictions do not allow certain limitations; in such cases, the above limitations apply to the fullest extent permitted.

12) Indemnification

You agree to indemnify, defend, and hold harmless First Eye Applications and its owners, directors, officers, employees, contractors, and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the App; (b) your violation of these Terms or applicable law; or (c) your violation of any third-party rights.

13) Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we reasonably believe you violated these Terms. Upon termination, your right to use the App ceases immediately.

14) Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflicts of law principles.

Informal resolution. Before filing a claim, you agree to attempt to resolve any dispute informally by emailing firsteyeapplications@gmail.com with “Dispute” in the subject line and a brief description. If we cannot resolve it within 30 days, the dispute may proceed as below.

Arbitration & class-action waiver (U.S. users). Except for disputes qualifying for small-claims court, any dispute arising out of or relating to these Terms or the App shall be resolved by binding arbitration administered by a reputable arbitration provider, on an individual basis only—no class actions or class arbitrations. Each party bears its own fees and costs, consistent with applicable rules. Opt-out: You may opt out of arbitration and the class-action waiver by emailing us within 30 days of first accepting these Terms; include your name and a clear statement of opting out.

If arbitration is unenforceable as to a particular claim, then you and we consent to exclusive jurisdiction and venue in the state or federal courts located in Delaware for that claim.

15) Changes to Terms

We may modify these Terms at any time. Material changes (including those affecting health-related information handling or presentation) will be highlighted in an updated in-app policy or release notes. Continued use after changes constitutes acceptance.

16) Severability; Assignment; Entire Agreement

If any provision is deemed unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions remain in full force. You may not assign these Terms without our consent; we may assign them. These Terms (plus the Privacy Policy) are the entire agreement between you and us regarding the App.
